Tovkin Terms of Service
Draft — requires attorney review. Not legal advice. Placeholders in [brackets]. The company is not yet formed; "[Tovkin, Inc.]" stands for the legal entity. Statements marked [CONFIRM] must be checked against the built app.
Last updated: [date]. Version 0.1 (draft 2026-10-16).
These Terms are a contract between you and [Tovkin, Inc.] ("Tovkin", "we", "us"). By creating an account or using Tovkin (the website, the app, and anything we send you) you agree to them. If you don't agree, don't use Tovkin. Our Privacy Policy, Consumer Health Data Privacy Policy and AI Disclosure are part of how Tovkin works. Where you are asked to give a specific consent (for sharing with a plus-one, or for Tovkin to act for you), that consent is separate from these Terms and you can say no to it and still use the rest of Tovkin.
1. What Tovkin is, and is not
Tovkin is a health companion. It gives general health information in plain English, helps you understand the preventive checks people commonly discuss with their clinicians, explains lab results you share, and helps you with the legwork of getting care (for example, asking for records or booking an appointment) when you ask.
Tovkin is not:
- a doctor, clinic, hospital, pharmacy or health plan;
- medical advice, diagnosis, or treatment, and it does not create a doctor-patient relationship with anyone;
- an emergency service. If you think you are having a medical emergency, call 911 (or your local number). If you are thinking about harming yourself, call or text 988. Tovkin cannot call for help for you, does not monitor you, and may not respond in time.
Always talk with a qualified clinician about your results, symptoms, medicines and decisions. Don't delay or skip care because of something Tovkin said.
2. AI
The Tovkin companion is an AI. It can be wrong, incomplete or out of date, and it does not know everything about you. Read the AI Disclosure. Staff at Tovkin (currently the founder) may help with requests you make and may review conversations as described in the Privacy Policy.
3. Who can use Tovkin
You must be 18 or older and live in the United States. Tovkin is for US residents only for now; we refuse sign-ups from outside the US, and we may close an account if we learn that a member lives elsewhere, after emailing you and offering a copy of your data. You must give us accurate information. One person, one account. You are responsible for what happens under your account; keep your email account secure, because that is how you sign in.
Early access: Tovkin is in a private early-access period. Features may change, break or be removed. Items marked "coming soon" aren't available. We may limit invitations.
4. Your account and invites
- You sign in with a link we email you. Don't share it.
- Sending a Tovkin: you can invite people you know. Only invite people who would reasonably expect and want it. Don't invite anyone whose email you got without their permission, and don't use invites to spam. We email each invitee once, with one reminder at most [CONFIRM], and honor opt-outs. We tell you who has started, never what is in their account.
- You are responsible for any invites you send. We may cap invites to prevent abuse.
5. Plus-one
You can invite one person (a "plus-one") to see what you choose. They only see items you switch on, only after they accept, and you can change or end it any time. The plus-one agrees to use what they see only to support you, to keep it private, and not to share it onward. Tovkin is not responsible for what a plus-one does with what you chose to share. Your specific consent is in CONSENT-WORDING.md (shown in the app when you add a plus-one).
6. Tovkin acting for you
You may ask Tovkin to do things such as request records or book an appointment. Tovkin acts only after you approve the specific request. Details of what you authorize, what we can share and who it goes to are in the approval screen. We are not your agent for medical decisions. We do not guarantee availability, prices or outcomes, and we are not responsible for the provider's acts. You can cancel a request before it is done and stop anytime. Third parties (for example a clinic) may keep records of the contact under their own rules.
7. Your content
You own what you give us (messages, uploads, health information, "your content"). You give us a limited license to host, process, analyze (including with AI), display and transmit it only to provide Tovkin to you and as described in the Privacy Policy, for example, to answer you and carry out your requests. We don't sell it or use it for advertising. You promise you have the right to upload what you upload (for example, you may upload your own results; don't upload someone else's health information without their permission).
8. Acceptable use
Don't: use Tovkin if you are under 18; impersonate someone; upload illegal content or malware; try to access other members' data or break Tovkin's security; scrape or reverse engineer it; use Tovkin to harass anyone; use it to get information to harm yourself or others; rely on it for emergencies; resell it; or use it to train a competing AI. We may suspend accounts that put others or Tovkin at risk.
9. Cost
Early access is free for founding members. If we introduce paid plans, we will tell you the price in advance, ask for your consent, and you will not be charged for anything you didn't agree to. [Payments are not live.]
10. Medical and AI disclaimers
Tovkin is provided "as is" and "as available". To the extent allowed by law, we do not promise that it is accurate, complete, error-free, or fit for a particular purpose, or that it will detect any condition. Information that looks normal is not a guarantee of health. Reference ranges and guidelines change; we cite sources and dates where we can.
11. Limits on our responsibility
To the maximum extent the law allows: (a) we are not liable for indirect, incidental, special, consequential or punitive damages; (b) our total liability to you for anything related to Tovkin is limited to the greater of $100 or the amount you paid us in the past 12 months. This doesn't limit liability that the law doesn't allow to be limited (for example, for our own fraud or gross negligence, or certain consumer rights in your state). [ATTORNEY: confirm enforceability, especially for health-related harm and in WA and CA.]
12. Indemnity
You are responsible for claims arising from your misuse of Tovkin, your violation of these Terms, or content you had no right to upload. [ATTORNEY: consumer indemnities are narrowly enforced; consider removing.]
13. Ending
You can delete your account any time in the app or by emailing hello@tovkin.com. We delete your data as described in the Privacy Policy. We can suspend or end your access if you break these Terms or if we need to protect people, with notice where practical. If we stop offering Tovkin we will give you notice and a chance to export your data.
14. Disputes
[ATTORNEY DECISION: choose one — (a) courts of [Delaware/Washington] with a small-claims carve-out, or (b) individual arbitration with an opt-out and a class waiver. Note that arbitration terms for health-related consumer apps are scrutinized; a founders' friends-and-family launch may want (a).] Governing law: [Delaware / Washington]. Nothing in these Terms takes away rights you have under your state's consumer protection law.
15. Changes
We may update these Terms. For material changes we'll give notice in the app or by email at least [14] days ahead. If you keep using Tovkin after that, you accept them; if not, you may delete your account.
16. Other
Entire agreement; if part is unenforceable the rest stands; no waiver unless in writing; you can't transfer your account; we can transfer these Terms in a sale of the business. Notices go to your account email and to hello@tovkin.com.
